REGARDING: Axe Throwing Events Release Of Liability, Waiver, And Assumption of Risk Document. (hereinafter as “Axe Throwing Events”)

“Axe Throwing Events”, For themselves, their owners, directors, agents, servants, employees, volunteers, parents, and subsidiary companies, administrators, trustees, successor’s and assignee’s, and any party that claims a right or interest through them. (hereinafter the “ Releasees”)

REGARDING: RECREATIONAL AXE THROWING (hereinafter the “Activity”)

I, the undersigned participant, hereinafter the “Releasor” , desire to participate in the activity on the date set forth below, which has been organized by the Releases.

In consideration for being allowed to participate in the activity on the date set forth below, i on behalf of myself, my representatives, heirs, successors, assigns, administrators, trustees, executors, and on behalf of any party who may claim a right or interest through me (“The Releasor”), hereby release acquit, and forever discharge without qualification or limitation, the Releasees from any and all claims, i may now have or may not in the future have against the Releasees, Including, but not limited to claims against the Releasees for negligence, gross negligence, carelessness, or claimed failure to take responsible steps to protect me from the risks, hazards, or dangers of participating in the activity, and from any and all claims for liability, for any personal injury, death, and/or property damage, expense and/or loss sustained by me as a result of my participation in the Activity do to any cause whatsoever.

Releasor hereby acknowledges and accepts that participation in this activity carries inherent risks and danger, and there is the possibility of personal injury, death, property damage, and or loss resulting from participation in the activity. Releasor acknowledges that injury may result, not only, from their own actions, but the actions or inactions of others, the condition of the premises, or any equipment used. Knowing this, Realeasor voluntarily assumes all risks known and unknown, associated in participating in the activity on the date below.

Releasors agrees that as a condition precedent to participation in the activity on the date set forth below, he/she/they must agree to be bound by the terms of this waiver and release of liability, and by signing below Releasor represents and acknowledges that he/she/they fully understands this waiver and agrees to be bound by its terms. Realesor further understands and agrees that he/she/they is not compelled to sign this waiver, should Releasor decline to sign the waiver prior to engaging in the activity, he/she/they will be issued a full refund of any sums paid on the date set forth below (not the original deposit of $100)

Releasor agrees that this release of liability, waiver, and assumption of risk contains the entire agreement between the parties here to, that the terms of this document are contractual and not a mere recital, that any breach of these terms may be enforced against the releasor, and may give rise to a damage claim against the releasor, enforceable, by a further legal proceedings. Releasor further acknowledges that the releasees have made no oral, written, or visual representations that are not otherwise reflected in this agreement.

Releasors agree that this agreement will be interpreted pursuant to the laws of the state of Connecticut, which shall retain exclusive jurisdiction of any legal claim arising from it or Releasors participation in the activity.

Releasors acknowledges that during the course of participation in the activity, Releasees may photograph, Record, or videotape releasor for promotional or other purposes. Releasors hereby give express permission for Releasees to capture his/her/they image, and to use the same for promotional, or advertising purposes, including: publishing, displaying, and or distributing said images or videos. Releasors acknowledges that any images or videos so taken shall be the exclusive property of releasees and waivers any right to inspect or approve of said images or video prior to their use by releasees. Releasor hereby releases and holds releasees harmless from any liability assuring out of the use of said images and videos in any manner or media whatsoever, and herby waive any claims and causes of action relating to the use of said images and videos including, but not limited to, claims for invasion of privacy.

The undersigned Releasor hereby states he/she/they has read the above liability Waiver, release and assumption of risk/s, understands that he/she/they is given up substantial rights by signing and hereby signs it voluntarily.
